BY BUYING ANY KIND OF ARTWORK FROM ME YOU AGREE TO THE RULES BELOW.

By ordering a commission from me, Katastrak ("the Artist"), you ("the Client", "(s)he/ they") affirm to have read and agree to be legally bound by the following Terms of Service listed below. Failure to abide by the Terms of Service may result in a rejected/ cancelled commission with or without a refund, and/ or a blacklist/ public service announcement. Please note that these Terms of Service may be subject to change without prior notice.These Terms of Service are in effect as of February 01, 2025.

SECTION 1.1 - WILL DRAWThe Artist is willing to draw any of the following:» Human(oid) | Kemonomimi | Anthros
keep in mind that characters with very "cute" traits will be slightly altered due to the Artist's art style.» Original Characters and/ or Fan Characters» Sonas
Personas, Fursonas, Monstersona, and others.» Couples Poly is viable here, but will cost extra» Fanart» Pin-up/ Nudity/ Suggestive» Light Gore
(Ex. Excessive blood, detached limbs, etc.)» Body horror» Explicit Sexual Content (NSFW)
Characters in appearance of the following age ranges will not be accepted:
Toddlers/ Children
Teenagers» Any couple type of any sexuality;

SECTION 1.2 - WILL NOT DRAWThe Artist will not draw any of the following:» NSFW featuring minors» Hate speech content» Some specific character's designs» Some specific Phobias» Sexualized underage characters (in actual age and appearance)» Pedophilic relations» Certain kinks/ fetishes (ex. watersports, Scat, DDLG...); the Client is asked to confirm with the Artist beforehand if a certain kink/ fetish is acceptable.» Characters without a decent Reference Sheet.
"Characters" with NO images references and information text, will be considered Custom. Keep it in mind.

SECTION 2 - GENERAL» The Artist has a right to refuse the commission for whatever reason, with or without explanation.
(Please see Section 6 - Refunds for more information on cancellations.)» The Client has a right to cancel the commission for whatever reason, with or without explanation.(Please see Section 6 - Refunds for more information on cancellations.)» The Artist has a right to upload the commission on any/ all social media (Tumblr, Twitter, Toyhou.se, Instagram, etc.) unless specified by the Client beforehand to keep the commission private.» Payment is to be made before the Client has approved the sketch.» The commission will be on an "on hold" status until payment has been received.» The Artist will work with deadlines or rush orders. But this will cost extra. (Like +25%~70% of the value base of the commission)» The Artist does not work on a "first come first serve" basis. Smaller commissions/ commissions that do not take much time may be worked on in between larger commissions/ commissions requiring more time.» NSFW commissions may only be ordered by a Client 18 years of age or older.
If the Artist has any reason to suspect the Client is underage while asking for an NSFW commission, the commission will be automatically rejected/ cancelled, in addition to a public service announcement being made.» The Client may contact the Artist at any time to ask for a progress check on the commission. But please, be kind and understand that the client's commission is not the only thing the Artist has to work with.» The Client is encouraged to follow the Artist (Tumblr, Twitter, Toyhou.se or Instagram). This is of great help and motivation to the Artist.

SECTION 3 - IMAGE RIGHTS» The Client may make minor edits to the completed commission (ex. Cropping, Adding text/ borders, Changing Brightness/ Contrast/ Hue/ Saturation...).» The Client may use/ reupload the commission for personal/ non-commercial use, but only if proper credit to the Artist (Katastrak) and a linkback to any of the Artist's social media (Tumblr, Twitter, Toyhou.se, Instagram) is provided.» The Client may not use the commission for any commercial use unless discussed with the Artist beforehand.» Commissions for commercial use will be charged more than personal/ non-commercial commissions.» If the commission includes
characters that do not belong the Client, the Client can not use the commission for commercial use unless explicitly written permission from the owner(s)/ creator(s) of said characters is provided.» The Client may not claim the commission as his/ her/ their own work, whether (s)he/ they did or did not make any edits to the commission.» The Client does not have the right to remove the Artist's Watermark on Artwork made by the Artist.» The Artist does not claim ownership to any of the characters/ subjects portrayed in the commission. Characters belong to their respective creator(s).

SECTION 4 - DELIVERY/ TURNAROUND» All commissions will be done digitally.» The Client is paying for a service/ digital good and will not require any shipping of any kind.» All commissions will be done in an in the Artist's art style. Don't suggest different kind of art style.
Except if the commission is "experimental" style, in this situation. The Client can suggest the art style with a reference image of the desired style» All commissions will be sent via Discord or Toyhouse.se with the completed commission .PNG file attached.» Unless specified not to upload the commission to the public, all commissions will be posted on the Artist's social media, resized and watermarked.» Commissions will be posted on the Artist's social media after the Client has received and approved the original commission file.» The Client may choose to remain anonymous when the Artist publicly uploads the commission.» Depending on the desired style and queue, the estimated turnaround is about one (1) week to two (2) months at the latest.» If the Artist has to take longer than two (2) months to complete the commission for whatever reason, the Client will be contacted and informed of the status of his/ her/ their commission.

SECTION 5 - PAYMENT» Payment is to be made before the Client has approved the sketch.
Payment is to be made via PayPal only.
In Brazilian case, Pix.» PayPal payment is to be done in USD (Dollar).» PayPal payment is be done using invoices. The Artist will require the Client's PayPal e-mail.» The Client does not need to pay extra for any of the PayPal fees. But if the Client wants to send some extra money, the Artist will accept and will be very happy.» Payment must be sent within 24 hours. If the payment cannot be sent within 24 hours, the commission will be Canceled.» The Artist is ok with payment deadlines, but keep in mind if the day of the payment expires, the progress of commission will be canceled.» It is the Client's responsibility to remember to pay the Artist if they have a payment plan, the Artist is not responsible for reminding the Client.

SECTION 6 - REFUNDS» Due to the country where the Artist lives, paypal maybe not allow refunds. Since there is a different means of terms of use for paypal in the country. Unfortunately, refunds maybe cannot be made. But, can be made:- Negotiations for changes in the type of commission within the amount paid.- Feel free to offer the money paid on characters "open for offer" folder on Toyhouse.- We have a wide variety of negotiation possibilities. but unfortunately, sending a refund is out of the question.» The Artist can TRY send a refund, maybe it will work or maybe not, since paypal's payment mechanism has changed.» The Artist feel bad about this situacion, please don't be rude when the Artist say "i can't do Refunds". Keep in mind that: It's NOT the Artist's fault.
- Any situation the Client is rude and don't understand the situation, the Client will be blocked and blacklisted.

SECTION 7 - COMMISSION PROCESS
The following is a sample of the Artist's commission process:» The Client orders a form using a contact with Discord or Toyhouse.
- Do not send a E-mail.» The Artist prefer use Discord to contact. (Katastrak)» After negotiation (the Client has to be clear on what (s)he/they wants. Ex. a Portrait with blood.) the Artist will say the total amount and ask if the client approves of this amount.» The Artist will ask the Paypal Email to send a invoice.» Upon confirmation that the payment has been received, the Artist will start making a sketch of the commission.» The Client will receive a rough sketch of the commission. Any and all major revisions must be done at this stage.» Upon completion of the commission, the Client will receive the commission file via Discord or Toyhouse. Only minor changes (ex. brightness, colour adjustments, etc.) can be made at this point. Any and all major revisions (ex. reposing, colour scheme change, etc.) will be rejected.» If permitted, the Artist posts a resized and watermarked version of the commission on social media.» If the Client wants it, it can be tagged in the post. (Ex. Custom to @user).

» If you want a complex background, everything is up for discussion. May add complex fee.

Monsters, Animals, Anthros, Humanoids, Dragons and anything your desires» May add complex fee» Please expect a long wait with these, they are very time-consuming and I always like to draw very slow this Commission type.I'm Ok with drawing characters naked for 18+ Commissioners (if desired) . A censored version will be included at end of the Commission. But first, ask me if i'm fine with this.~

» In Custom case:
Make sure you send me the Moodboard + a text with ALL the features you want in the design. Be very specific in what did you want, i'm very picky about taking custom commissions.» In Ref. case:
Make sure you send me the character design by image, NOT by text, otherwise it will be considered a Custom.~! Be very specific in what you want during the "sketch" phase, after that, no changes will be made.Read my Terms of Service first.
